US Court Orders Release of Kilmar Abrego Garcia from Immigration Detention

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks lawful basis.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.

The situation originates in a mistaken removal to El Salvador in March, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling allegations, he was held in federal detention.

In her order, the judge noted that the government lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Case

The legal proceedings center on disputed assertions. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this allegation.

He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in the state of Tennessee.

Terms of Release

The court, who was hearing his challenge to removal in a federal court, determined that he must now comply with the terms of his bond from jail in Tennessee. This order shifts his supervision to the Tennessee court.
